Rule 78
Evaluation of performance
(1) Work performance evaluation form to be used for evaluation of the annual work performance of gazetted civil servants according to schedule-15 and Work performance evaluation form to be used for evaluation of semi-annual and annual work performance of gazetted civil servants Schedule-15A. It will be according to.
(2) For the evaluation of the performance of civil servants, the concerned employee at least one grade above the employee to be evaluated shall be the supervisor and the concerned employee one grade above the supervisor shall be the reviewer. But–
(a) The supervisor of gazetted employees shall not be a gazetted employee unless the gazetted employee is the head of the office.
(b) If there is no gazetted employee who will be the reviewer of the gazetted employee in the offices located in the district, the authorized reviewer designated by the chairman of the review committee will be the reviewer.
(c) If the supervisor of a gazetted employee is a gazetted special category employee, he shall also act as a reviewer.
(d) The employee who works as the head of office or departmental head can work as a supervisor for the purpose of evaluating the performance of the employees of the same category working under him. Explanation:- If the employee to be evaluated and the employee who is his supervisor are of the same category and both are potential candidates for promotion to the same service, group or subgroup, for the performance evaluation of such employee, the employee who will be the supervisor should submit his written opinion along with the basis mentioned in the performance evaluation form. The form should be submitted to the reviewer or a superior employee for supervision.
(e) The Chief Secretary shall supervise the performance evaluation of the civil servants working in the gazetted special category and the civil servants permanently working in the special category posts.Observer, reviewer and review committee will also work.
(3) There will be the following review committee for evaluating the performance of gazetted employees:-
(a) Secretary of the concerned ministry, secretariat or commission or the officer designated by the head of the concerned department – Chairman
(b) Corresponding Reviewer – Member
(c) Superintendent concerned – Member
(4) There will be the following review committee to evaluate the performance of gazetted first class civil servants and if the officers mentioned in clauses (b) and (c) below are the same, the members of the said committee will also include the Secretary of the Cabinet Secretariat:-
(a) Chief Secretary – Chairman (b) Secretary or special category officer of the concerned ministry, secretariat, commission, department or office - member
(c) Secretary of the Ministry relating to Service Group – Member
(4a) Notwithstanding anything else written in this rule, in the case where such a position is vacant or the tenure of such a position is vacant in an agency headed by a special category official, the performance evaluation of the gazetted first class civil servants of such agency and the head of department under that agency shall be done by the following officer: -
(a) Supervisors and Reviewers – Secretary to the Office of the Prime Minister and the Council of Ministers (b) Review Committee:
(a) Chief Secretary – Chairman
(b) Secretary to the Ministry of General Administration – Member
(e) Secretary of the Office of the Prime Minister and the Council of Ministers - Member, but if there is a situation where the Secretary of the Ministry of General Administration remains in place, the most senior Secretary will represent the Secretary of the Ministry of General Administration as a member in the review committee.
(5) There will be the following review committee for performance evaluation of gazetted second and third class civil servants:-
(a) Secretary or special category officer of the concerned ministry, secretariat, commission or office - Chairman
(b) The Secretary of the Ministry of Service, Group or the concerned Ministry, Secretariat, Commission or the person designated by himGazetted First Class Officer of Railways – Member
(c) Gazetted first-class officer-member of the Ministry of General Administration, but if all three officials in the review committee belong to the same ministry, the officer to be appointed according to clause (b) shall be appointed from another ministry.

(7) The supervisor, reviewer and review committee should give marks for the performance of the employees according to the basis mentioned in the performance evaluation form.
(7a) If the retired civil servant is reinstated according to the court's decision, he will be given marks in the same proportion as he got in the performance evaluation of the year immediately before retirement. However, in the case of civil servants who have been reinstated before the end of the year, the performance of their duties will be evaluated for the entire period of that year.
(8) The review committee may adopt the following procedures regarding the performance evaluation form of gazetted employees:-
(a) To scrutinize the submitted work performance evaluation forms and maintain harmony between the work performance and the distribution of points in those forms,
(b) To consider the interrelationship between the overall achievement of an agency and the evaluation of the performance of its employees,
(c) Requesting confirmation from the reviewer or supervisor or sending a request for reconsideration if deemed necessary in the submitted performance evaluation forms,
(d) If the re-submitted performance evaluation form is found to be "not justified" or without revision of marks, the review committee shall comment on the matter and send it in writing to the relevant body to keep records of such supervisor or reviewer.
(8A) If the review committee has to award a score of more than 95 percent and less than 75 percent to any civil servant for performance evaluation, the clear reason must be disclosed.
(9) After the commencement of this regulation, when calculating the points of performance evaluation, the law of promotionThe average score will be calculated based on the performance evaluation of the previous financial years. …………….
